THE MINISTRY OF ECONOMIC DEVELOPMENT OF THE RUSSIAN FEDERATION HAS UPDATED RECOMMENDATIONS ON THE ASSESSMENT OF REGULATORY IMPACT IN THE REGIONS
The Ministry of Economic Development of the Russian Federation approved methodological recommendations on the implementation of the procedure for assessing the regulatory impact and the procedure for assessing the application of mandatory requirements and expertise in the constituent entities of the Russian Federation.
«In recent years, there have been many innovations in regulatory policy, primarily related to the adoption of the federal law «On Mandatory Requirements in the Russian Federation», – Alexander Litvak, Director of the Department of Regulatory Policy and Regulatory Impact Assessment comments. – «The approval of new methodological recommendations will allow the regions to determine the vector for the development of regulatory policy, taking into account the best practices».
The document contains updated approaches to conducting regulatory impact assessment (RIA), in particular, it proposes a transition to a decentralized model for conducting RIA. This approach implies an independent assessment by the developer of the potential consequences of the introduction of the proposed regulation, including costs for business. At the same time, within the framework of public consultations, the department takes into account the proposals and comments submitted by the business. The authorized body provides control over the quality of the procedure by the developer.
Recommendations are also given on the procedure for assessing the application of mandatory requirements and assessing the actual impact in the constituent entities of the Russian Federation.
The order came into force on January 1, 2023.
